How to request deletion of your personal data from AITEX Agency

AITEX Agency respects your right to control your personal data. This page explains how you can request deletion of data we hold about you, in accordance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), Meta’s Platform Terms, and other applicable data protection laws.

1. What Data Can Be Deleted

You may request deletion of the following types of personal data:

For End Users (people who received WhatsApp messages from a business using our platform):

  • Your WhatsApp phone number stored in our systems.
  • Message history and conversation logs associated with your number.
  • Any order details, transaction references, or other data submitted during a WhatsApp conversation.
  • AI conversation session history.

For Clients (businesses using our platform):

  • Account information (business name, contact details, billing address).
  • API configuration settings and usage logs.
  • Message templates and analytics data.
  • Billing records (subject to legal retention requirements — see Section 4 below).

2. How to Request Data Deletion

Option A: Email Request

Send an email to privacy@aitex.agency with the following information:

  • Subject line: “Data Deletion Request”
  • Your full name (or business name if you are a Client).
  • WhatsApp phone number associated with the data (include country code).
  • Email address associated with your account (if applicable).
  • Description of what data you would like deleted (or state “all data”).
  • Proof of identity: We may ask you to verify your identity before processing the request to ensure we do not delete someone else’s data.

Option B: Through the Business That Messaged You

If you received WhatsApp messages from a business that uses our platform, you can contact that business directly to request deletion of your data. As the Data Controller, the business is responsible for handling your request and will instruct us (as the Data Processor) to delete the relevant data from our systems.

Option C: Via WhatsApp

You can also reply STOP to any WhatsApp message received through our platform. This will opt you out of future messages. To request full data deletion, please use Option A (email) above.

3. What Happens After Your Request

  1. Acknowledgement: We will confirm receipt of your request within 3 business days.
  2. Verification: We may contact you to verify your identity. This is to protect you from unauthorized deletion requests.
  3. Processing: Once verified, we will delete your personal data from our active systems within 30 days.
  4. Confirmation: You will receive a confirmation email with a unique reference code once the deletion is complete.
  5. Backup removal: Data in backup systems will be removed within 90 days of the deletion request, in accordance with our backup rotation schedule.

4. Data We May Need to Retain

In certain circumstances, we may be required to retain some data even after a deletion request. These exceptions include:

  • Legal obligations: Billing records and transaction data that must be retained for tax, accounting, or regulatory compliance purposes (typically 2 years after account termination).
  • Legal disputes: Data subject to a legal hold, ongoing litigation, or regulatory investigation.
  • Meta requirements: In accordance with Meta’s WhatsApp Business Terms (Section 12), WhatsApp may retain data associated with your WhatsApp Business Account for up to 90 days following termination, with limited copies retained in backup storage.
  • Fraud prevention: Minimal data required to prevent fraud or enforce our Terms of Service.

Where we retain data under these exceptions, we will inform you of the specific reason and the expected retention period.

5. Data Deletion for Facebook App Users

If you have connected to our services through Facebook and wish to delete your data, you can also initiate the process through Facebook:

  1. Go to your Facebook profile’s Settings & Privacy > Settings > Apps and Websites.
  2. Find AITEX Agency and click Remove.
  3. In the popup, select Delete all activity and click Send Request.

This will trigger a data deletion request that we will process in accordance with the steps outlined in Section 3.

6. Your Other Data Rights

In addition to data deletion, you may also have the right to access, rectify, restrict processing of, or request portability of your personal data. For full details on all your data rights, please see Section 9 of our Privacy Policy.
